1. Agreement to Terms
By accessing or using FiatFussion (the "Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
2. Description of Service
FiatFussion is a peer-to-peer marketplace that connects buyers and sellers of cryptocurrency. The Service holds cryptocurrency in escrow during active trades and provides dispute resolution, identity verification, and reputation features. FiatFussion does not custody fiat currency, does not act as a counterparty to trades, and does not provide investment, financial, or legal advice.
3. Account Registration
- You must be at least 18 years old to use the Service.
- You agree to provide accurate, current, and complete information during registration and verification.
- You are responsible for safeguarding your account credentials and 2FA. All activity under your account is your responsibility.
- You agree to notify us immediately of any unauthorized access.
4. KYC and Verification
The Service uses tiered identity verification (KYC). Higher trading limits, certain payment methods, and merchant tier require additional verification. You consent to the collection and verification of identity documents necessary to operate the Service in compliance with applicable anti-money-laundering (AML) laws.
5. Trades and Escrow
- When a trade opens, the seller's cryptocurrency is locked in FiatFussion's escrow until release conditions are met.
- Trades must be completed within the time window stated on the offer.
- You agree to communicate exclusively through the Service's chat. Off-platform conversations cannot be used as evidence in disputes.
- The Service may automatically cancel trades that exceed their time window without buyer payment.
6. Fees
- FiatFussion charges a flat 1% maker fee on the cryptocurrency leg of every completed trade. Takers pay no platform fee.
- Verified merchant accounts qualify for a reduced 0.6% maker fee.
- Network gas (blockchain transaction fees) is paid to the relevant blockchain network, not to FiatFussion.
- Fees may be updated with at least 30 days' notice.
7. Disputes
- Either party to a trade may raise a dispute through the dispute portal.
- Disputes are reviewed by FiatFussion arbitrators based on chat history, submitted evidence, and trade history.
- Decisions are binding within the platform. Crypto in escrow is released according to the decision.
- Bad-faith disputes, falsified evidence, and abuse of the dispute system result in account penalties or termination.
8. Acceptable Use
You agree not to:
- Use the Service for money laundering, terrorism financing, fraud, sanctions evasion, or any illegal activity.
- Attempt to circumvent KYC, verification, or trading limits.
- Use the Service to facilitate transactions involving stolen funds or property.
- Conduct off-platform trades while using the Service for verification or reputation only.
- Attempt to compromise, reverse-engineer, or exploit the Service's infrastructure.
- Create multiple accounts to evade limits or bans.
9. Restricted Jurisdictions
The Service is not available in jurisdictions where its operation would violate applicable law. You are responsible for verifying that your use of the Service is lawful in your jurisdiction. The Service may decline access from certain countries based on regulatory requirements.
10. Counterparty Risk
FiatFussion is a marketplace. Your trade counterparty is another individual user. While the Service provides escrow and dispute resolution, FiatFussion is not responsible for losses arising from counterparty fraud, payment chargebacks, off-platform agreements, or other actions outside the Service's escrow protection.
11. Intellectual Property
All software, branding, content, and documentation associated with FiatFussion are the property of FiatFussion or its licensors. You receive a limited license to use the Service in accordance with these Terms.
12. Disclaimers
The Service is provided "as is" and "as available." FiatFussion disclaims all warranties to the maximum extent permitted by law. Cryptocurrency trading involves substantial risk. Past trading volume or completion rates do not guarantee any particular outcome.
13. Limitation of Liability
To the maximum extent permitted by law, FiatFussion's aggregate liability arising from or related to the Service shall not exceed the fees you paid to FiatFussion in the twelve (12) months preceding the claim. FiatFussion is not liable for indirect, consequential, or incidental damages.
14. Termination
We may suspend or terminate your account for violation of these Terms, suspected fraud, or as required by law. Upon termination, you may withdraw remaining balances subject to any holds related to active disputes.
15. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated via email or in-product notice at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance.
16. Governing Law
These Terms shall be governed by and construed in accordance with applicable international commercial-arbitration principles. Any disputes shall be resolved through binding arbitration as specified in our dispute-resolution policy.
